Terms and Conditions
1. Who we are, and what this is
Tennis Junkie is a coaching platform for tennis clubs, coaches and players, operated by Adeptum AB, company registration number 559494-1824, a company registered in Sweden ("Adeptum", "we", "us"). You can reach us at info@adeptum.se or at www.adeptum.se.
These terms form an agreement between you and Adeptum covering your use of the platform. By creating an account, or by continuing to use an account you already have, you accept them. If you are accepting on behalf of a club or a coaching business, you confirm that you are authorised to bind it, and "you" then means that organisation as well as yourself.
2. Your account
You sign in through a third-party identity provider. Keep that sign-in secure; anything done through your account is treated as done by you. Tell us promptly if you believe somebody else has reached it.
You must be at least 13 years old to hold an account of your own. Below that age, a parent or guardian must consent, and the club or coach inviting the child is responsible for obtaining that consent before adding them. A club or coach that adds a member under 13 warrants to us that it holds the guardian's consent to do so, and will produce evidence of it on request.
Account details must be accurate. We may suspend or close an account that is used in breach of these terms, and will tell you why unless we are prevented from doing so by law.
3. Using the platform properly
You agree not to: use the platform unlawfully or to harm anybody; upload content you have no right to upload; upload anybody's personal data without a lawful basis for doing so; attempt to reach accounts, data or systems that are not yours; probe, scan or interfere with the service or its security; scrape it or use it to build a competing product; or misrepresent who you are.
Search and the finding of other players exist so that people who train together can find each other. Using them to compile lists of people, to contact people commercially, or to approach children is a breach of these terms.
4. Fees, payment and cancellation
Paid plans are charged in arrears, one month at a time. At the start of each month we invoice the month that has just ended, and the agreement continues until cancelled. Prices are shown before you commit and include or exclude VAT as stated at the time. Card payments are handled by Stripe; we do not receive or store your full card details.
Added to the plan's fee is the use of the AI features metered over the same month, as described in section 5. That part varies with how much the features were used, and is nothing in a month they were not. Where AI is included in your plan or in a running trial, no such fee is added, though the usage is still counted.
You may cancel at any time with effect from the end of the current month. Because payment is taken in arrears, a final invoice for that month follows, covering the use made of it. We may change prices for future months with at least 30 days' notice, and you may cancel before the change takes effect.
If you are a consumer buying at a distance, you have 14 days from entering the agreement to withdraw from it under the Swedish Distance Contracts Act (lag (2005:59) om distansavtal och avtal utanför affärslokaler). If you ask us to begin the service within that period and then withdraw, we may charge for the part already delivered. Your withdrawal right ends once the service has been fully performed with your consent.
If payment fails, we may suspend paid features after telling you. We may charge interest on late payment at the rate set by the Swedish Interest Act (räntelagen (1975:635)) and recover reasonable collection costs.
5. Metering, logging and platform access
By using the platform you accept that we measure and record how it is used. Specifically:
- Metering. Use of AI features is counted per request and per account, and these counts determine what is billed and what is included in a plan.
- Operational logging. We record sign-ins, requests, errors and similar technical events to keep the service running, secure and accountable.
- Usage and product analysis. We analyse how features are used, in aggregate, to decide what to build and fix.
- Support access. Our staff can, where it is necessary to investigate a fault or a report of misuse, view the platform as a given account sees it. Every such access is recorded, including who did it and when.
We do not sell your data, and we do not use third-party advertising or cross-site tracking.
6. Personal data
This section is the information we are required to give you under Article 13 of the General Data Protection Regulation (EU) 2016/679 ("GDPR"). We follow the GDPR and Swedish data protection law.
Controller. For accounts, sign-in, billing, security and the operation of the platform, Adeptum AB is the controller. For the training data a club or coach records about its players, the club or coach is the controller and we act as their processor; section 7 governs that processing.
What we process. Your name, email address and language; your club, coach and team memberships; training data such as sessions, attendance, drills, measured results, notes and progress; badges, experience points and friendships; an approximate area of about a kilometre across, derived in your browser and stored only as that area, where you have allowed it; billing and subscription details; and technical data such as sign-in times, requests, device and browser information and IP address.
Why, and on what legal basis. To provide the platform and perform our agreement with you (Art. 6(1)(b)); to bill, to keep the service secure, to prevent misuse and to improve the product, in our legitimate interests (Art. 6(1)(f)); to meet accounting and other legal obligations (Art. 6(1)(c)); and, where we ask for it separately, on your consent (Art. 6(1)(a)) — location sharing being the clearest example, which you can refuse or withdraw at any time without losing anything else.
Who else sees it. Our hosting and infrastructure providers; Google, for sign-in; Stripe, for payments; and the provider of the AI features, which receives the training data needed to produce a comment or a plan. We use suppliers inside the EU/EEA where we can. Where data reaches a country outside it, the transfer is covered by an adequacy decision or by the European Commission's standard contractual clauses, and you can ask us for a copy of the safeguards.
How long. Account and training data for as long as the account exists and up to 12 months after it is closed; accounting records for seven years, as Swedish law requires; technical logs normally up to 12 months.
Your rights. You may ask for access to your data, for it to be corrected or erased, for processing to be restricted, and for a copy in a portable form. You may object to processing based on our legitimate interests, and withdraw any consent you have given. Write to info@adeptum.se and we will answer within one month. If you are unhappy with how we have handled it, you may complain to the Swedish Authority for Privacy Protection (Integritetsskyddsmyndigheten, IMY), Box 8114, 104 20 Stockholm, imy@imy.se.
Cookies. We set only what the service needs to work: a session cookie that keeps you signed in, and a cookie remembering the language you chose. We use no analytics or advertising cookies, which is why we do not ask you to accept any.
Automated decisions. The AI features suggest and comment; they make no decision that has a legal or similarly significant effect on anybody. A coach decides what to do with a suggestion.
7. When we process data for a club or a coach
Where a club or a coach uses the platform to record data about its players, that club or coach is the controller and Adeptum is its processor. This section is the written agreement required by Article 28 of the GDPR, and applies between us and that club or coach.
- Subject matter and duration. Processing of player data for the purpose of running the platform, for as long as the club's or coach's account exists.
- Nature and purpose. Storing, organising, showing and analysing training data so that coaches can plan and players can follow their progress.
- Data and data subjects. The categories described in section 6, concerning players, coaches and staff of the club.
- Instructions. We process the data only on the controller's documented instructions, which these terms and the use of the platform's features constitute, unless required otherwise by EU or member state law, in which case we will tell the controller first unless that law forbids it.
- Confidentiality. Everybody we authorise to process the data is bound to keep it confidential.
- Security. We take appropriate technical and organisational measures under Article 32, including access control, encryption in transit, and recorded, restricted staff access.
- Sub-processors. The controller gives general authorisation for the sub-processors named in section 6. We will give notice of an intended change and the controller may object on reasonable data protection grounds, in which case either party may terminate the affected service.
- Assistance. We will help the controller, so far as is reasonable, to answer data subject requests and to meet its obligations under Articles 32 to 36, and will notify it without undue delay of any personal data breach we become aware of.
- Return and deletion. On termination we will delete the data, or return it, at the controller's choice, except where storage is required by law.
- Audit. We will make available the information needed to demonstrate compliance and allow an audit, on reasonable notice, not more than once a year unless a supervisory authority or an incident requires otherwise, and at the controller's cost.
8. Training carries risk
Tennis Junkie organises and records training. It does not supervise it. Nothing on the platform — a drill, a plan, a suggestion from an AI feature, a measured result — is medical advice, physiotherapy, diagnosis, or a judgement that any particular exercise is safe for any particular person.
Deciding what is suitable and safe is for the coach on the court and the player doing it, in consultation with a doctor where appropriate. You take part in physical training at your own risk. Stop and seek medical attention if something hurts.
9. Content and intellectual property
The platform, its software, design, and its built-in drill library are owned by Adeptum or licensed to us, and nothing here transfers that ownership. You are granted a non-exclusive, non-transferable right to use the platform while your account is in good standing.
What you create stays yours: your drills, session plans, notes and training data belong to you or to your club. You grant us the licence we need to host, display, back up and process that content in order to provide the service, and to produce anonymous, aggregated statistics that identify nobody. We claim no other right to it.
If you send us feedback or ideas, we may use them without obligation to you.
10. Availability
We work to keep the platform available and to look after your data, but we do not promise that it will be uninterrupted, error-free, or that it will suit any particular purpose. The service is provided as it is and as it is available. We may change, add or withdraw features, and will give reasonable notice before withdrawing something you depend on.
Maintenance, third-party outages and events outside our control will sometimes interrupt the service. Keep your own copies of anything you cannot afford to lose; the platform's export features exist for that.
11. Liability
Nothing in these terms limits liability that cannot be limited by law. That includes liability for death or personal injury caused by negligence, for intent or gross negligence, for fraud, and any liability a consumer has under mandatory Swedish law.
Subject to that, and to the fullest extent Swedish law allows:
- We are not liable for indirect or consequential loss, loss of profit, revenue, goodwill, anticipated savings, business opportunity, or for loss or corruption of data beyond restoring from our most recent backup.
- Our total liability arising out of or in connection with these terms and the service, whether in contract, tort or otherwise, is limited in aggregate to the fees you paid us for the service in the twelve months before the event giving rise to the claim, or SEK 5,000 where you paid us nothing.
- We are not liable for what a club, a coach or another user does with the platform, for content they upload, for decisions they take about training, or for injury arising from training.
- We are not liable for failures of third-party services we depend on, beyond taking reasonable care in choosing them.
A claim must be brought within twelve months of the day you became aware, or ought reasonably to have become aware, of the circumstances giving rise to it, except where mandatory law gives you longer.
12. Your responsibility to us
If you are a club, a coach, or any other business user, you will hold us harmless against claims, losses and reasonable costs arising from: your breach of these terms; content you or your members upload; your handling of personal data, including the consent required for members under 13; and your use of the platform in breach of the law. This does not apply to consumers.
13. Events outside our control
Neither party is liable for failing to perform where the cause is beyond its reasonable control, including war, civil unrest, terrorism, natural disaster, epidemic, strike, failure of public communications networks or power, or the failure of a supplier for the same reasons. Payment obligations already due are not suspended by this clause.
14. Changes to these terms
We may change these terms. A change is published as a new version, and you will be asked to accept it before you continue to use the platform. The version you accepted stays available so that you can see what you agreed to. If you do not accept a new version you may stop using the service and cancel. Because payment is taken in arrears, you are then invoiced only for the use already made.
15. Term and termination
These terms apply for as long as you have an account. You may close your account at any time. We may terminate or suspend with 30 days' notice, or immediately where you are in serious or repeated breach, where the law requires it, or where continuing would expose us or another user to harm. Sections that by their nature should survive termination — payment owed, intellectual property, liability, and governing law — do so.
16. Governing law and disputes
These terms are governed by Swedish law, without regard to its conflict of law rules. Disputes are to be settled by the Swedish general courts, with Stockholms tingsrätt as the court of first instance.
If you are a consumer, this does not deprive you of the protection of mandatory rules in your country of residence, nor of the right to bring proceedings where you live. You may also refer a dispute to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN, Box 174, 101 23 Stockholm, www.arn.se), or use the European Commission's online dispute resolution platform.
17. The rest
If a provision is held invalid, the rest stands and the invalid part is read down to what the law allows. Our not enforcing something is not a waiver of it. You may not transfer your rights under these terms without our consent; we may transfer ours to a group company or to a buyer of the business, and will tell you if we do. These terms, together with any order confirmation, are the whole agreement about their subject matter.
